1. General


1.1.

This data protection declaration explains the type, scope and purpose of the processing of personal data within our company and the websites, functions and content associated with it. The data protection declaration applies regardless of the domains, systems, platforms and devices used (e.g. desktop or mobile) on which the online offer is run.


1.2.

For the terms used, such as "personal data" or their "processing", we refer to the definitions in Article 4 of the General Data Protection Regulation (GDPR).



2. General information on data processing


2.1. Scope of processing of personal data

In principle, we only process the personal data of our users to the extent that this is necessary to provide a functional website and our content and services. The processing of this data takes place regularly only with the consent of the user. An exception applies in such cases in which it is not possible to obtain prior consent for actual reasons and the processing of the data is permitted by statutory provisions.


2.2. Legal basis for processing personal data

Insofar as we obtain the consent of the person concerned for the processing of personal data, Art. 6 I 1 lit.a DSGVO serves as the legal basis. Art. 6 I 1 lit.b GDPR serves as the legal basis for the processing of personal data required to fulfill a contract between us and the data subject. This also applies to processing operations that are necessary to carry out pre-contractual measures, in particular customer inquiries. Insofar as the processing of personal data is necessary to fulfill a legal obligation to which we are subject, Art. 6 I 1 lit.c DSGVO serves as the legal basis. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 I lit.d GDPR serves as the legal basis. If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and fundamental freedoms of the data subject do not outweigh our legitimate interest, Art. 6 I 1 lit.f GDPR serves as the legal basis for the processing.


2.3. Data Erasure and Storage Duration

The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage no longer applies. Storage can also take place if this has been provided for by European or national legislators in EU regulations, laws or other regulations to which we are subject. The data will also be blocked or deleted if a storage period prescribed by the standards mentioned expires. Unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.



3. Your rights in relation to personal data concerning you

If personal data is processed by you, you are the data subject within the meaning of the GDPR and you have the following rights vis-à-vis the person responsible.


3.1. Right of providing information

You can request confirmation from us as to whether personal data relating to you is being processed by us. You also have the right to request information as to whether your personal data is being transmitted to a third country or to an international organization. In this context, you can request to be informed of the appropriate guarantees pursuant to Art. 46 GDPR in connection with the transmission.

If personal data concerning you is being processed, you can request information from us about the following:

  • The purposes for which the personal data are processed;
  • The categories of personal data being processed;
  • The planned duration of the storage of the personal data concerning you or, if specific information on this is not possible, criteria for determining the storage duration;
  • The existence of a right to rectification or erasure of personal data concerning you, a right to restriction of processing by us or an objection to such processing;


3.2.

You have the right to rectification and/or completion if the processed personal data concerning you is incorrect or incomplete. We have to make the correction immediately.



4. Changes to the Privacy Policy


4.1.

We reserve the right to change the data protection declaration in order to adapt it to changed legal situations or to changes in the service and data processing. However, this only applies with regard to declarations on data processing. If customer consent is required or parts of the data protection declaration contain provisions of the contractual relationship with the customer, the changes will only be made with the customer's consent.


4.2.

Customers are asked to inform themselves regularly about the content of the data protection declaration.
